Abstract
The article is devoted to the study of the genesis of the institution of newly discovered circumstances in civil procedural law through the prism of the doctrine of unavailability of evidence with due diligence. The author analyzes the historical development of this institution from Roman law to modern legal systems, identifies the conceptual link between the criterion of objective unavailability of information and the procedural good faith of the party. The paper substantiates the thesis that the modern construction of newly discovered circumstances is a direct continuation of the Roman legal idea of restitutio in integrum based on ignorantia facti invincibilis.
