Annotatsiya

Ushbu maqolada xonliklar davrida qozi, muftiy va hukmdorlarning islom huquqi rivojidagi hissasini ko‘rib chiqamiz. Odatda islom qonunchiligini ishlab chiqishda o‘rta asrda asosan faqih va muftiylar shug‘ullanishgan bo‘lsa, keyinchalik bu ishda qozixona mutasaddilari va hatto hukmdorlar ham faol ishtirok etishgan. Markaziy Osiyoda xonliklar davrida o‘rta asrda yaratilgan ko‘plab fiqhga oid asarlarda bayon qilingan masalalardan keyingi davr qozi va muftiylar ittifoqida ixtiyor qilingan fiqhiy masalalar majmuidan iborat to‘plamlar (jo‘ng, majmua) yaratildi. Bu to‘plamlar qozilik amaliyoti uchun keng qo‘llanib kelindi.

Abstract

This article examines the roles of qadis (judges), muftis, and rulers in the evolution of Islamic law during the period of the Central Asian khanates. While the development of Islamic legal norms in the early Middle Ages was primarily the domain of faqihs (jurists) and muftis, subsequent periods saw active participation from judicial officials (qadi-khana) and even the sovereigns themselves. During this era, specialized collections of legal opinions known as jungs or majmuas were compiled. These volumes aggregated the most relevant legal issues selected through the collaborative efforts of judges and muftis. These compendiums served as practical manuals, widely implemented within the judicial proceedings of the time. The khanate period was also marked by the creation of works on fatwas (legal rulings) produced either under the direct patronage of rulers or authored by them personally.
