Maqolada suvga bo‘lgan huquqning inson huquqi sifatidagi mazmuni hamda davlatning transchegaraviy suv resurslari ustidan suvereniteti o‘rtasidagi nisbat xalqaro huquq nuqtayi nazaridan tahlil qilinadi. Iqtisodiy, ijtimoiy va madaniy huquqlar to‘g‘risidagi xalqaro paktning 15-sonli umumiy sharhi, BMT Bosh Assambleyasining 64/292-sonli rezolyutsiyasi, 1997-yilgi Xalqaro suv oqimlaridan kemachilikka aloqador bo‘lmagan maqsadlarda foydalanish huquqi to‘g‘risidagi konvensiya, Xalqaro sud va hakamlik sudlarining amaliyoti o‘rganiladi. Adolatli va oqilona foydalanish, sezilarli zarar yetkazmaslik hamda hayotiy zarur ehtiyojlarning ustuvorligi prinsiplari o‘zaro bog‘liq tizim sifatida ko‘rsatiladi. Markaziy Osiyo amaliyoti va O‘zbekiston Respublikasining 2025-yilgi Suv kodeksi tahlil qilinib, milliy qonunchilikni takomillashtirish bo‘yicha takliflar beriladi.
Abstract
The article analyses, from the perspective of international law, the relationship between the content of the right to water as a human right and State sovereignty over transboundary water resources. It examines General Comment No. 15 of the Committee on Economic, Social and Cultural Rights, General Assembly resolution 64/292, the 1997 Convention on the Law of the Non-Navigational Uses of International Watercourses, and the case law of the International Court of Justice and arbitral tribunals. The principles of equitable and reasonable utilization, no significant harm and the priority of vital human needs are presented as an interrelated system. On the basis of Central Asian practice and the 2025 Water Code of the Republic of Uzbekistan, the article proposes ways to improve national legislation.
